General Terms and Conditions of Sale — S.A.R.L Bellidays Travel Tours
1) Scope of Application
These General Terms and Conditions of Sale apply to all services provided by Bellidays Travel Tours in the course of operating under its passenger road transport licenses, private hire vehicle (VTC) licenses, bicycle rental and excursions, and the organization of tourism services such as guided tours and travel concierge services.
2) Service Definition
The service includes the booking and provision of a vehicle in perfect working condition, a qualified driver and/or guide, professional civil liability insurance for transported passengers, fuel, mileage and time as per the quotation, with departure from and return to our base.
For Travel Advisor / Travel Planner / Travel Concierge services, a flat fee will be charged for connecting the client with a local service provider (€50 to €100).
3) Price Determination
A fixed price is agreed upon in the specific terms and conditions. This flat rate includes the driver's and/or guide's meal allowance when service takes place between 12:00 PM and 2:00 PM or between 8:00 PM and 10:00 PM (€20 allowance), and overnight accommodation if required (€150).
Unless otherwise stated in the specific terms and conditions, the following are not included: admission fees to paid monuments and sites, overtime charges (€120 for a driver; €150 for a driver-guide; €90 for a private guide), additional mileage (€2.50/km), and any additional services not mentioned. These supplements will be added to the price. The flat rate is subject to a 25% surcharge between 8:00 PM and 7:00 AM, or on Sundays and public holidays, calculated pro rata based on driving time. Any changes to the scheduled times and mileage of the transport will result in a modification of the quoted amount. For on-demand services, any hour commenced shall be charged in full.
Prices shown on our rate schedules or quotations are established based on economic conditions known at the time of their preparation.
Accordingly, Bellidays Travel Tours reserves the right to modify its rates in the event of a fluctuation in the determining factors of its pricing, particularly fuel costs.
Any debt recovery proceedings initiated by Bellidays Travel Tours, or any entity mandated by it, following a late payment shall result in the payment of, in addition to statutory interest and any recovery costs, a flat-rate compensation of €50 as damages, in accordance with the provisions of Articles 1152 and 1226 of the French Civil Code relating to penalty clauses.
Route extensions or detours for reasons beyond the client's control (roadworks, diversions, adverse weather conditions, etc.) shall not be charged.
Such circumstances shall not constitute grounds for a claim entitling the client to a refund, price reduction, or compensation.
The rates indicated are valid until December 31, 2026, and are subject to change without notice.
4) Booking Terms
Bookings are made by telephone or email at least 24 hours before the scheduled departure time of the service (unless otherwise specified in the specific terms and conditions) and are subject to vehicle availability.
The client is hereby informed that Bellidays Travel Tours reserves the right to subcontract all or part of the service, which the client unconditionally and expressly accepts.
Acceptance of the quoted rate constitutes acceptance of these General Terms and Conditions of Sale.
5) Payment Terms
A minimum deposit of 50% of the initially agreed fixed price is due upon booking.
Unless otherwise agreed with Bellidays Travel Tours, the balance of payment must be settled before the service begins (except under a subscription contract).
In all cases, the person making the booking and signing the order form is jointly and severally liable for payment together with the user.
For long-term services and account customers, invoices or statements may be settled through periodic payments according to specific terms and conditions.
Credit card payments are accepted. Bank charges related to the payment order in connection with international wire transfers are the responsibility of the client.
In the event of non-payment by the due date, our invoices shall automatically and without prior formal notice bear interest at the statutory rate, plus a flat-rate compensation of €50 for recovery costs.
6) Cancellation Policy
In the event of contract cancellation by the client, regardless of the cause, more than two months before the departure date, a full refund will be issued. For cancellations between 60 and 30 days before the service date, the 50% deposit will be retained by our company. Bookings not cancelled at least twenty-nine days before the service, or in the event of the client's no-show at the pick-up point, will be charged at the full initially agreed fixed price. In the case of payment by credit card or American Express, a 3% processing fee corresponding to bank transaction charges will be applied in the event of cancellation and refund.
7) Unavailability
Should the carrier be unable to provide the vehicle or guide specified in the contract, all sums already paid will be fully refunded without recourse or compensation for any damages incurred. However, the deposit will be retained if both parties agree on the booking of an alternative service.
In the event of a breakdown or accident during the service rendering the vehicle unavailable, the service charge will be calculated pro rata based on the time elapsed, without recourse or compensation for any damages incurred.
Bellidays Travel Tours is not liable for delays or cancellations caused by weather conditions or traffic conditions.
8) Safety and Damage
The driver must comply with traffic regulations and the regulations governing daily driving and rest periods. The driver is prohibited from violating these rules, even at the client's request.
Passengers shall allow the driver to open and close the doors. In the event of damage to the interior equipment or other damage to the vehicle — for example, from the untimely opening of doors — the resulting damage shall be borne by the client, with a minimum flat-rate charge of €150.
Smoking is prohibited inside the vehicles. The driver is instructed to stop to allow smokers a break if they wish. If the driver becomes aware that the client is committing an infraction, the driver is instructed to immediately terminate the service in progress. Such termination shall not entitle the client to any refund or compensation.
No animals are permitted in the vehicles unless in a cage or sealed container designed for that purpose, or by prior agreement.
9) Insurance and Liability
In accordance with the law, passengers transported in our vehicles are insured against possible accidents within the limits of the carrier's liability.
Any loss, theft, or damage must be the subject of a written report with the driver and a police report.
Repatriation costs in the event of illness or death remain solely the responsibility of the client.
Under no circumstances shall Bellidays Travel Tours' liability extend to direct or indirect damages suffered by the client as a result of any vehicle delay.
10) Force Majeure
Bellidays Travel Tours shall not be held liable if the non-performance or delay in the performance of any of its obligations described in these General Terms and Conditions of Sale results from a case of force majeure. Force majeure is defined as any external, unforeseeable, and irresistible event within the meaning of Article 1148 of the French Civil Code.
11) Disputes
Subject to legal provisions, any dispute arising from this contract shall fall under the exclusive jurisdiction of the Commercial Court of Rennes.
This contract is governed by French law.
